1 This is a companion case to Fields v. State, Okl.Cr., 284 P.2d 442, decided by this court May 18, 1955. The plaintiff in error, Lorenzo Alphonso Hayes, hereinafter referred to as defendant, was jointly charged with Ernest Fields with the murder of Vol Dale Royster. A severance was granted, Fields was tried first, convicted and assessed the death penalty, but this court modified the sentence to life imprisonment. Herein the defendant was also convicted, was sentenced to life imprisonment, and the case is now here on appeal.
